KCSARC legal advocates always prepare clients for the possibility of long waits in the criminal legal system. Before the pandemic closed courts, that wait could be many months. During the pandemic, things came to a standstill. We wanted to see what was happening /

Earlier this year, we analyzed client data in cases charged and pending to see how many sexual assault victims were among those waiting and for how long, to understand their age and gender and to assess the severity of charges that had been filed in their cases. /

The 408 sexual assault victims involved in these cases, have been waiting an average of 563 days — almost 19 months — from the time the defendant in their case was arraigned. Their median age was 16. Median age of the 319 defendants involved was 39. /

Their cases involve serious criminal charges: 73% of all charges are crimes committed against children. 38% of those are Class A felonies such as Rape of a Child 1, Child Molestation 1, and Assault of a Child 1. /

Long waits and lack of information is keeping victims from moving on with their lives, and potentially jeopardizing their safety, and mental as well as physical health now and down the road. /
